Welcome to Instant Book Publishers. By accessing or using our services, including ghostwriting, editing, publishing, marketing, and other related offerings, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.
Acceptance of Terms
By using our website or services, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you do not agree, please refrain from using our services.
Services Provided
We offer various creative and publishing services, including but not limited to:
- Ghostwriting
- Editing
- Book formatting
- Publishing assistance
- Printing
- Marketing
The scope and details of the services will be outlined in individual agreements or project scopes provided for each service.
Client Responsibilities
To ensure successful project completion, you agree to:
- Provide clear and complete project details and instructions
- Respond to our communications in a timely manner
- Review and approve drafts or submissions promptly
Failure to fulfill these responsibilities may result in delays or additional charges.
Intellectual Property
a. Ownership
- Upon full payment for ghostwriting services, all rights to the completed work transfer to the client.
- For collaborative projects, ownership terms will be specified in the project agreement.
b. Originality
We ensure that all work delivered is original and free from plagiarism. However, we are not liable for any claims arising from content provided by the client.
Payment Terms
a. Pricing
Prices for services will be outlined in individual project agreements or invoices.
b. Payment Schedules
- Payment may be required upfront, in installments, or upon project completion, depending on the agreed terms.
- Non-payment may result in project suspension or termination.
c. Refund Policy
Refund requests are reviewed on a case-by-case basis. Refunds may not be issued for services already rendered or if work has commenced on your project.
Project Onboarding and Commencement of Services
a. Service Initiation:
Upon execution of the service agreement and/or receipt of the initial payment/deposit, the Company officially allocates administrative, operational, and creative resources to the Client's project.
b. Onboarding Allocation:
The formal onboarding process—including but not limited to the scheduling and execution of the strategic Welcome Call, establishment of client accounts, allocation of project management dashboards, and scheduling of production timelines—constitutes the immediate commencement of billable professional services.
Cancellation & Refund Policy
a. Non-Refundability of Onboarding and Commenced Services:
Because operational resources are locked and administrative tasks are executed immediately upon contract signing, all initial deposits, setup fees, or first stage installments are strictly non-refundable once the onboarding process or Welcome Call has taken place.
b. Change of Mind & External Circumstances:
Subject to applicable consumer protection laws, the Company cannot issue refunds or waive contractually agreed-upon balances solely due to a Client’s change of mind, unexpected personal schedule adjustments, or unforeseen external circumstances (including, but not limited to, medical conditions, personal emergencies, or changes in financial situation) occurring after resource allocation has begun.
Crucial Legal Safeguard (Manuscript Withholding):
c. Client Delay and Manuscript Submission:
The Client's failure to submit manuscripts, outlines, or necessary working materials does not halt or invalidate the active status of the project, nor does it pause the consumption of operational overhead. The Company remains ready, willing, and able to perform the services; therefore, a delay or failure on the Client's part to supply materials does not constitute a ground for cancellation or a refund of fees paid.
Project Suspension & Multi-Book Credits (ALTERNATIVE REMEDY)
a. Safe Harbor Provision for Extenuating Circumstances:
In the event that a Client experiences a verified medical condition or personal emergency that prevents them from proceeding with production, the Company may, at its sole discretion, offer a Project Suspension / Credit Voucher in lieu of cancellation or monetary refund.
- The active project may be placed on a formal hold for a maximum period of twelve (12) months from the date of suspension notice.
- Any funds paid toward multi-book bundles or outstanding services will be preserved as a dollar-for-dollar credit toward the Client's account, to be reactivated when the Client is medically or personally capable of resuming work
- the project is not reactivated within the designated twelve (12) month period, all credits will permanently expire, and all outstanding balances for work blocked or reserved will remain due
Multi-Volume / Bundle Protections
Indivisibility of Package Pricing:
When services are purchased as a multi-book package (e.g., a 4-book publishing bundle), the pricing structure, discount margins, and resource scheduling are calculated based on the entire scope of work. Multi-book packages are non-severable. A client may not cancel a single component or individual book within a package to demand a partial or prorated refund for remaining unproduced volumes once the master project infrastructure has been launched.
Confidentiality
We respect the confidentiality of your content and personal information. All materials shared with us will remain secure and will not be disclosed to third parties without your consent, except as required by law.
Limitation of Liability
We are not responsible for:
- Losses resulting from delays caused by client actions or external factors
- Outcomes related to third-party platforms, such as publishing delays or rejection
- Indirect, incidental, or consequential damages arising from the use of our services
Revisions Policy
a. Number of Revisions
The number of revisions included in your service package will be specified in the project agreement.
b. Additional Revisions
Revisions beyond the agreed limit may incur additional charges.
Termination of Services
a. By the Client
Clients may terminate services by providing written notice. Refund eligibility will depend on the stage of the project and work completed.
b. By Instant Book Publishers
We reserve the right to terminate services if:
- The client violates these Terms and Conditions
- There are communication breakdowns or payment issues
Third-Party Platforms and Tools
Our services may involve the use of third-party platforms, such as Amazon KDP, Barnes & Noble, or IngramSpark. While we assist with these processes, we are not liable for the policies or actions of these platforms.
Governing Law
These Terms and Conditions are governed by and construed under the laws of Florida. Any disputes shall be resolved in the courts of Florida.
Changes to Terms and Conditions
We reserve the right to update these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Continued use of our services constitutes acceptance of the revised terms.
